Pedestrian Killed in Crash on Power Inn Road near Calvine Road
by Culver Legal, Personal Injury Attorneys
The Crash
On Friday morning, February 28, a woman was struck by a vehicle on Power Inn Road just south of Calvine Road in South Sacramento. She was pronounced dead at the scene. According to authorities, the victim was crossing the roadway outside of a marked crosswalk when she was struck by an approaching vehicle.
The California Highway Patrol is leading the investigation. The victim's identity had not been released pending family notification at the time of publication. Emergency responders and law enforcement secured the area while conducting crash reconstruction.
Investigation Factors
Investigators are examining multiple potential contributing factors, including:
- Lighting conditions at the time of the crash
- Driver attentiveness and speed
- The pedestrian's crossing location
- Whether the driver attempted to brake or swerve
Crossing Outside a Crosswalk Does Not Eliminate Legal Rights
A common misconception is that pedestrians who are hit while crossing mid-block or outside a crosswalk have no legal recourse. Under California's comparative negligence law, a pedestrian's partial fault does not bar recovery — it simply reduces the amount of compensation they can receive.
Drivers have a duty to exercise reasonable care and watch for pedestrians at all times, regardless of where the pedestrian is crossing. If a driver was speeding, distracted, or otherwise negligent, they may still be held liable even if the pedestrian was not in a crosswalk.
