Texas and federal employment laws protect workers against unpaid wages, workplace safety violations, discrimination, harassment, retaliation, and wrongful termination. Despite these protections, employers routinely violate workers' rights — withholding overtime pay, misclassifying employees as independent contractors, retaliating against whistleblowers, and permitting hostile work environments.

Common employment law violations include unpaid overtime under the federal Fair Labor Standards Act, misclassification of employees as independent contractors, discrimination based on race, gender, age, disability, religion, or national origin under the Texas Commission on Human Rights Act (Texas Labor Code Chapter 21) and federal Title VII, sexual harassment and hostile work environment claims, wrongful termination in violation of public policy, and retaliation against employees who report illegal activity.

Available remedies can be substantial — including back pay, front pay, emotional distress damages, attorney's fees and costs, and reinstatement. In cases involving malice or reckless indifference to a worker's protected rights, compensatory and punitive damages may also be available, subject to the statutory caps in Texas Labor Code Chapter 21.
